These Terms & Conditions (the “Terms”) govern your access to and use of the FINFATech website, and the financial intelligence, forensic advisory, financial planning & analysis (FP&A), AI-powered business intelligence services, and the productized offerings FINFA Monitored™ and the Financial Health & Integrity Score™ (collectively, the “Services”). By accessing the website or engaging the Services, you agree to be bound by these Terms.
Agreement to Terms
By accessing this website, requesting a proposal, or entering into an engagement with FINFATech, you confirm that you have read, understood and agree to be bound by these Terms and by any applicable engagement letter or statement of work. If you are accepting these Terms on behalf of an organization, you represent that you are authorized to bind that organization. If you do not agree, you should not use the website or the Services.
Description of Services
FINFATech is a financial intelligence, forensic advisory, FP&A and AI-powered business intelligence firm. We turn raw financial data into profit, control and decision-ready strategy. Our Services include, without limitation:
- Financial Intelligence & Profitability Analysis — surfacing hidden profit, margin leakage and performance drivers across the business.
- Forensic Analytics & Financial Integrity — investigative analysis to detect anomalies, irregularities and indicators of fraud or financial misstatement.
- Financial Planning & Analysis (FP&A) — forecasting, budgeting, scenario modeling and decision support.
- AI-Powered Business Intelligence, Dashboards & Visualization — continuous, decision-ready reporting.
- FINFA Monitored™ — a subscription offering providing continuous financial integrity monitoring rather than one-time, reactive engagements.
- Financial Health & Integrity Score™ — a measurable indicator of an organization’s financial health and control environment.
The Services are advisory and analytical in nature. They are not a statutory audit, an attestation, a legal opinion, a tax filing, or regulated investment advice, and they do not replace the work of your auditors, legal counsel or tax advisors.
Engagements & Scope
Specific Services are delivered under a separate engagement letter, statement of work, order form or subscription agreement (an “Engagement”) that defines the scope, deliverables, timelines, fees and any service-specific terms. Where an Engagement conflicts with these Terms, the Engagement controls for that matter. Any work beyond the agreed scope requires a written change order. Findings, deliverables and scores reflect the information made available to us during the agreed period and are not a guarantee of completeness or of future outcomes.
Client Responsibilities
The quality of financial intelligence depends on the quality of the data behind it. Accordingly, you agree to:
- Provide accurate, complete and timely access to relevant financial data, records, systems and personnel.
- Hold all necessary rights, consents and authority to share such data with us, including in respect of any third-party or personal data.
- Designate a point of contact empowered to make decisions and provide approvals.
- Use our findings, dashboards and scores responsibly, applying your own management judgment before acting on them.
We are not responsible for conclusions affected by incomplete, inaccurate or withheld information.
Confidentiality
We treat your financial data and non-public information as confidential and use it solely to deliver the Services. Each party agrees to protect the other’s confidential information with at least reasonable care and not to disclose it except to personnel and subcontractors who need it to perform the Services and who are bound by equivalent obligations, or as required by law. These obligations survive termination. Confidentiality does not extend to information that is or becomes public through no fault of the receiving party, or that was lawfully known without obligation.
Intellectual Property
The website, the Services, the underlying methodologies, models, scoring frameworks, software, dashboards, templates and all related materials — including FINFA Monitored™ and the Financial Health & Integrity Score™, and all associated trademarks — are owned by FINFATech or its licensors and are protected by intellectual-property laws. Subject to payment and to these Terms, you receive a limited, non-exclusive, non-transferable license to use deliverables for your internal business purposes. You retain ownership of your own underlying data. You may not copy, resell, reverse-engineer or build a competing product from our methodologies or materials.
Use of AI & Limitations
FINFATech uses artificial intelligence as an enabler of human expertise — never as a replacement for it. AI helps us analyze large volumes of financial data, detect patterns and accelerate insight, but every meaningful output is reviewed and validated by qualified professionals before it informs a recommendation.
You acknowledge that AI-assisted outputs, dashboards, anomaly flags and scores are decision-support tools. They are probabilistic and may contain errors or omissions, and they are not a substitute for professional, accounting, legal, audit, tax or investment advice. You remain responsible for your own decisions and for obtaining independent professional advice where appropriate. Continuous monitoring under FINFA Monitored™ reduces but does not eliminate financial risk, and a Financial Health & Integrity Score™ is an indicator, not an assurance opinion or a guarantee against fraud, loss or misstatement.
Fees & Subscriptions
Fees, billing frequency and payment terms are set out in the applicable Engagement. Project-based fees are payable as invoiced; subscription Services such as FINFA Monitored™ renew for successive terms unless cancelled in accordance with the subscription agreement. Unless stated otherwise, fees are exclusive of applicable taxes, and amounts paid are non-refundable except where required by law. We may suspend Services for overdue amounts and may revise pricing for future terms with reasonable notice.
Disclaimers
The website and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, FINFATech disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the website will be uninterrupted or error-free, or that any analysis, forecast or score will achieve a particular financial result. Forward-looking analysis necessarily involves assumptions and uncertainty.
Limitation of Liability
To the fullest extent permitted by law, FINFATech and its personnel will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the website or the Services. Our total aggregate liability for any claim arising from an Engagement will not exceed the fees paid by you for that Engagement during the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless FINFATech, its affiliates and personnel from and against any claims, losses, liabilities and reasonable expenses (including legal fees) arising from your breach of these Terms, your misuse of the website or deliverables, or your provision of data that you were not authorized to share or that infringes the rights of a third party.
Governing Law
These Terms are governed by the laws of the jurisdiction in which FINFATech is established, without regard to conflict-of-law principles. The courts of that jurisdiction will have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Services, subject to any mandatory rights you may have under local law.
Changes to Terms
We may update these Terms from time to time to reflect changes in our Services, technology or legal requirements. The “Last updated” date above indicates when the latest version took effect. Material changes will be posted on this page, and your continued use of the website or Services after changes take effect constitutes acceptance of the revised Terms.
